1. HOW TO ENTER
a. The Carrabba’s “It’s Time to Vote Charlotte (the “Conest”) will begin on Monday, August 11th, 2008 at 8:30 am Eastern Time (“ET”) and end on Monday, August 25nd, 2008 at approximately 10:00 am ET.
b. To participate in the contest, you may enter via the following method: Beginning at 8:30 am ET on August 11th, 2008, go to the contest page on www.k1047.com. Choose your favorite Carrabba’s dish and enter it in and complete an official entry form that including first name and last name, complete address, city, state, zip code, home telephone number, business telephone number, valid email address, and date of birth. All entries must be received by Friday, August 22nd at 5:30pm ET.
c. One Internet entry per person and one Internet entry per email address. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online serve provider or other organization that is responsible by assigning email address or the domain associated with the submitted email address. For purposes of these Official rules, “receipt” of an online entry occurs when the http://www.k1047.com/ servers record the entry information upon clicking the submit button. Any automated computer receipt (such as one confirming delivery of the e-mail) does not constitute proof of actual receipt by WKQC of an online entry for purposes of these official rules. Use of any devise to automate entry is prohibited.
d. WKQC (the “Station”) is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches.
2. ELIGIBILITY RESTRICTIONS
a. The contest is open to all WKQC listeners who are 18 years of age or older and who reside in North Carolina or South Carolina. Employees of WKQC, its licensee, its corporate parents, subsidiaries, and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the Charlotte metropolitan area and the members of their immediate families and/or households are ineligible to participate or win. Subject to all applicable federal, state and local laws and regulations.
b. Listeners are eligible to win WKQC contest only once every sixty (60) days. Listeners are eligible to win a prize valued at $600 or more only once every six (6) months. Only one winner per household is permitted in any contest.
c. Winner will be required to sign all required releases and present government issued photo identification in order to claim prize.
d. Contestants are required to provide truthful information and the Station will reject and delete any entry it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any entry received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.
3. PRIZES
a. Four (4) prize will be awarded. Each prize is a $45 gift certificate from Carrabba’s Italian Grill which the winner may redeem at any U.S. Carrabba’s Italian Grill location. Expiration date is December 31st, 2008. Gift certificate does not include gratuity and taxes. Approximate Retail Value: $45.00
b. All prizes or prize certificates may be picked up at the office of Station at the address below. The winner will forfeit any prize or prize certificate not claimed within forty-five (45) days of winning. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. WKQC is not responsible for the safe arrival of a prize or prize certificate.
c. Note: There is no substitution, transfer, or cash equivalent for prizes, except that Station may, at its sole discretion, substitute prizes of comparable value or cash due to prize unavailability or where required by law. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. All winners of certificates or vouchers will be subject to the terms and conditions as set forth by the provider of the certificate or voucher. Other restrictions may apply.
4. WINNER SELECTION AND NOTIFICATION
a. Decisions of Station management with respect to the contest are final.
b. Four (4) winners will be selected on Monday, August 25th at approximately 10:00 am ET in a random drawing of all eligible entries received.
c. Odds of winning depend on the number of eligible entries received.
d. Winner need not listen or be present to win.
e. Winner will be contacted by phone and/or email on Monday, August 25th. If Station is unable to contact potential winner within five (5) days of notification attempt then the potential winner forfeits prize and an alternate winner will be selected in a random drawing of all remaining eligible entries.
f. Winner must execute and return any required Affidavit of Eligibility/Release of Liability Prize Acceptance Form within forty-five (45) days of winning or potential winner forfeits prize and an alternate winner will be selected in a random drawing of all remaining eligible entries [are you sure you want to select another winner 45 days after the contest ends if a winner doesn’t claim the prize and sign the release?]. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner forfeits prize.
5. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners may be required to sign an IRS Form W-9 or the equivalent.
b. By participating in the contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, Station in its sole discretion may require contest winners (and their travel companions, if any) to sign a liability release, agreeing to hold Station, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.
d. Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the WKQC Web Site or is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
e. Station reserves the right to make changes in the rules of the contest, including the substitution of a prize or equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event is delayed, rescheduled, postponed, cancelled, or has a change of venue, the Station reserves the right, but not the obligation, to cancel or modify the contest and shall not be required to award a substitute prize.
f. Failure to comply with the contest rules may result in a contestant’s disqualification solely at the discretion of Station.
g. Station is not responsible for typographical or other errors in the printing, the offering or the administration of the contest, or in the announcement of a prize.
h. Copies of the written contest rules and a list of winners (when complete) are available during regular business hours at the main studio of WKQC, 4015 Stuart Andrew Blvd., Charlotte, NC 28217.
